According to the Resolution, land lease exemptions will apply to projects operating in priority investment sectors or located in priority investment areas as stipulated under the Law on Investment, the Capital Law, and related Government decrees.

Overview of the session.
To qualify for the land lease exemption, a project must fall under the scope defined in Article 1 of the Resolution, specifically, it must use land for production or business within a priority investment sector or area. In addition, the project must meet at least one of the following two conditions: it must either be a non-profit project or be listed under the categories of socially incentivized investments determined by the Prime Minister.
If a project receiving land lease exemptions under this Resolution is later adjusted in a way that no longer meets the eligibility conditions, the exemptions will be revoked in accordance with the provisions of the Resolution.
The specific exemption benefits are as follows:
For non-profit projects that fall under Article 1, the full land lease amount will be waived for the entire lease term.
For projects that meet the criteria for socially incentivized investments as determined by the Prime Minister and are located in the following areas:
In central wards such as Hoan Kiem, Cua Nam, Ba Dinh, Ngoc Ha, Giang Vo, Hai Ba Trung, Vinh Tuy, Bach Mai, Dong Da, Kim Lien, Van Mieu – Quoc Tu Giam, Lang, O Cho Dua, and Hong Ha, land lease fees will be exempted for 15 years within the lease term. This does not apply to socially incentivized projects in hospital construction, higher education, or vocational education.

In other specified urban wards such as Linh Nam, Hoang Mai, Vinh Hung, Tuong Mai, Dinh Cong, Hoang Liet, Yen So, Thanh Xuan, Khuong Dinh, Phuong Liet, Cau Giay, Nghia Do, Yen Hoa, Tay Ho, Phu Thuong, Tay Tuu, Phu Dien, Xuan Dinh, Dong Ngac, Thuong Cat, Tu Liem, Xuan Phuong, Tay Mo, Dai Mo, Long Bien, Bo De, Viet Hung, Phuc Loi, Ha Dong, Duong Noi, Yen Nghia, Phu Luong, Kien Hung, Thanh Liet, land lease fees will be exempted for 30 years during the lease period.
Again, this does not include socially incentivized projects in hospital construction, higher education, or vocational education. For all remaining wards and communes not listed above, land lease fees will be exempted for the full lease term.
If a project is located across two wards or communes that fall under different preferential zones, it will be entitled to the higher level of land lease exemption.
If a project qualifies for preferential treatment under both the Capital Law and the Council's Resolution and the levels of exemption differ, the project will receive the most favorable exemption available.
If a project is already enjoying a more generous land lease exemption than that stipulated in this Resolution, it will continue to benefit from the existing preferential policy for the remainder of the lease period.
However, if the current exemption is lower than what is allowed under the new Resolution, the project will be eligible to apply the more favorable terms for the remaining period starting from the date the Resolution comes into effect. Projects whose exemption periods expire before the Resolution takes effect will not benefit from the new exemptions.
